The old optional 2-day contract cancellation is gone. Under SB 766, most used car buyers now get an automatic 3-day right to cancel.

What changed on October 1, 2026
Senate Bill 766, the California Combating Auto Retail Scams (CARS) Act, took effect on October 1, 2026. It replaces the older rule that made dealers offer an optional, paid 2-day contract cancellation on used cars under $40,000.
The 3-day right to cancel
For a used vehicle priced at $50,000 or less, you can return it within three calendar days, extended if the dealer is closed on the last day. The statute says calendar days, even though at least one DMV summary has described them as business days, so go by the statute and don't wait until the last minute.
- The right is void if you drive more than 400 miles.
- The car has to come back in the same condition.
- The dealer can charge a restocking fee of 1.5 percent of the price, at least $200 and no more than $600.
- Past 250 miles, the dealer can add $1 per mile, up to $150.
- The dealer must refund you within 48 hours.
Total price, up front
Dealers have to show the total price in ads for a specific vehicle and in their first response to you. Add-ons must be disclosed as optional, and dealers can't charge for add-ons that give you no benefit, such as nitrogen-filled tires below 95 percent purity.
Use the 3 days for an inspection
Three days is enough time to get the car to an independent, BAR-registered shop for a pre-purchase inspection. Ask for a written estimate for the inspection, ask the shop to scan for stored trouble codes, and bring the car back to the dealer within the mileage and time limits if something serious turns up.
